FASTWAY COURIERS LTD - UK

We hold a lot of prepaid labels and satchels bought from these crooks which, of course, are now worthless. There is a message on the number we telephone for collections that the company ceased trading at 7pm on 6th Sepember 2011 in Sussex there is no evidence that there is any bankruptcy registered with Companies House, its not our driver/franchee's fault he has lost a 5-figure sum. Fastway Couriers continue to trade in other UK areas under various guises. Their website is www.fastwaycouriers.co.uk where they sell franchises but have no telephone number or email for customers. They have a "Customer Testimonial" section on their website. I telephoned one of these customers and they have had many calls from various parts of the country from people who have been turned over in the same way as us. Initially a salesman who sold us the package came from Brackheath Couriers Ltd T/A Fastway Couriers (Sussex). AVOID AT ALL COSTS.

We have been told today by our Franchisee, Jimmy Stewart covering the Baildon/Bradford area that he will only collect parcels that can be delivered locally and not to pass to him any parcels that are out of the Bradford/Leeds region. We too have lots of vouchers to use up. I will pursue this matter through the Courts to retrieve our out of pocket expenses if i have to. They have already lost 3 parcels and we have claims in for over £600
Anyone had any joy with serving court papers against this company as it looks as though we are heading this way, pretty quickly....

Anonymous (not verified) — Fri, 23/09/2011 - 3:09pmyorks fastway has gone into liquidation i have been to sheffield today to collect my parcels, i suggest anyone who has anything missing goes to the sheff branch at shearings house near medowhall and tries to find the item.
the national company went bust earlier in the year but manchest yorks and another have kept trading until yesterday.
parcels to go are offering a deal on your old tickets.

Anonymous (not verified) — Mon, 26/09/2011 - 2:32pmMany thanks for the above post, Fastway Couriers Yorkshire base in Shearings House, Tinsley S9 1XA, closed its doors 3pm Thursday 22nd September 2011, Reportedly still trading from their Leeds office we got no responce on either advertised number. I have just got back from the depot to collect my goods there is thousands of ponds of goods sat in the unit currently unclaimed not going anywhere. The owners have jumped ship and left us high and dry. There are some posatives as this company was not limited so the owner can not run and hide, I am in the process of finding out their details and will be processing a claim against them for the value of the unused tickets, and any undelivered goods. will update when we have more details

Has anybody had any dealings with a Raj Sanai who is or was the Sheffield franchisee. I have just used him for an international backload and he ripped me off by bringing virtually nothing back.Still handing out cards from the Sheffield office claiming he is Fastway but now goes by the name of expcouriers and calls himself Roger which is quite bizarre.I wouild be interested to know if anyone else has had dealings with this guy who I have reported to the police and am building a civil case against him.He is a disgrace to the courier proffession and a fraud as he hands out cards with false company details on.

Does anyone know the address of the Baildon/Bradford Franchisee, Jimmy or James Stewart and i will prepare an online summons to serve on his personally. I had a conversation with him today and he tells me he is working with XPD Couriers and basically told me to stop moaning as i wasn't the only one who had lost lots of money, all his customers had lost money - and he thought this would make me feel better !!! Joke !! He felt quite smug when he said all your cheques you made out to CF Admin and not my name, so you can't pursue me, its nothing to do with me, you need to take legal action against Amit who owns the Leeds Depot. I said, you've been paid commission on all the tickets you have sold and he said yes, i have but that is my money - can you believe the cheek of someone to admit this !! Anyone with any advice here, please let us all know. These guys in business should not be allowed to get away with what they are doing.... it sounds to me as though they all knew what they were up to here.....

Anonymous (not verified) — Tue, 04/10/2011 - 12:45pmI was working for Fastway Yorks as a sub-contractor when it went down. Myself and all the other drivers are owed thousands in unpaid invoices. I lost almost £1500 myself. None of us had any warning that the company was about to go under and are just as much victims as customers who have been left with unuseable tickets ( and that includes Jimmy who lost not only the invoices unpaid but the 15000£ he paid for his franchise. My advice would be to sue Fastway Global who own the worldwide franchise for the brand and also own the Manchester franchise.

IMPORTANT :
Take a look at this link. This shows the fastway franchisees as 'being independently owned' this is something that i think everyone should put in their particulars of claim when preparing their summons to retrieve their losses. How can they say this was nothing to do with them personally and we should all sue the leeds depot or whichever depot when all the information, including sign writing on their van, says independently owned by the franchisee - they are just a joke.
I'm not giving up here and if anyone knows where the Bradford Baildon Idle Franchisee James Jimmy Stewart lives, do let the rest of us know, so we can all get our money back. If anyone gets any further information on submitting any claims against these lot, please share all information you have.

If you put Amit Desai's name in it will come up with his two companies and his address. You can also do a Companies House webcheck on any limited company you need to find out about. This is all free. It is Desai you need to chase as the franchisee/drivers lost all the money they had put in too. Our driver, here in the South, used to start at about 5am and finish about 7pm each day. He built up his round and had just sold part of it of for £11,000. The guy who bought it had an £11,000 loan and none of the drivers had more than a minutes notice that their rounds had gone. There appears to have been an official investigation into Desai which possibly means that the company was not run properly, therefore as a director he could be liable to pay you all back. You need to band together up there and get some legal advice before he does a runner.

Not the best news if hidding behind Limited Company but there is some legal loop hole that says if the company was not managed currectly the directors can be held responcable and it looks as if these guys have not been playing ball

Anonymous (not verified) — Tue, 27/09/2011 - 5:32pmHi, yes i am aware of the JSD business - this was an Order made by the Court to wind the company up AND in the interest of the public too - i got a copy of the court order and have this printed off - but this was as long ago as end of June ... i cant believe the franchisees didn't know... but at the end of the day, my business was put to the franchisee who sold himself as owning his own business and that this was run independently - nothing to do with a 'regional franchise' that is something else and my contract was with the franchisee. I think if the franchisee was a little more sincere, it would help heal the wounds, but the attitude from him was not good and at the end of the day, in law, you have to establish firstly, was there a contract and if so, between whom and for what? The franchisee's van says he runs the franchise as an independent business and all the jargon on the internet says the same thing, chasing Amit is a waste of time and difficult to prove that the running of the business was not done so in an ethical manner, i would have thought ?? In my eyes the franchisee has had the commission and benefited from the contract i had with him and i have suffered losses - which are very easily evidenced. Making a cheque payable to a third party at the instruction of the franchisee i don't see elimates anything from a contract between the two parties ie myself and the franchisee..... Sick to death of these rogues is how i feel.

Also, there was a guy called Roy whom i was told was invovled in this muddle somewhere. He was based in Sheffield i think ....

I've followed the fastways
Anonymous (not verified) — Wed, 05/10/2011 - 12:39pmI've followed the fastways saga for a number of years now and watch them churn area franchises of in order to make money. Whist your agreement will be with the courier driver (little more than a van driver) and in this case Jimmy Stewart they cannot operate without having a regional franchise (the depot) in place. It is the latter who arranges the trunking of parcels up and down the country.
It's set up this way so that if owner driver goes into liquidation then the regional franchisee does not bear any financial responsibility. This continues up the chain, if the regional franchise goes bust the master franchise will not have liability. As a result franchise after franchise are re sold whilst the poor courier driver is at the bottom of the pile dealing with irrate customers who have failed to grasp the concept of who their agreement was with and just looked at the remarkably low cost of the tickets.
I'm not suprised that the owner driver has washed his hands of this. He will have no doubt invested upwards of £10,000 and worked all the hours under the sun to make things work. When the regional franchise went under the master franchise will offer no support and the owner couriers have nobody to move the freight up and down the country. The Yorkshire regional franchise would probably have around 10 owner couriers working out of that depot and each owner courier now has to deal with 50+ customers chasing them for money that they simply don't have.
From a legal perspective you will need to take the owner courier to court although it's the master and regional franchisees that should be bearing the brunt of complaints.
So whilst I have sympathy for you regarding your lost money I also pity the owner courier who has lost more than you can imagine.
